Bitvoya Limited Hotel Booking Service Agreement

Important Notice: Bitvoya Limited (hereinafter referred to as “the Company”), based in Hong Kong, provides hotel booking services to registered and verified users of Bitvoya Travel (hereinafter referred to as “you”) under this agreement. This agreement is legally binding for both you and the Company.

The Company hereby reminds you to carefully read and fully understand all the terms of this agreement, especially those related to responsibilities and rights. Please read carefully and decide whether to accept this agreement.

The Service

1.1 The hotel booking service refers to the hotel booking service provided by the Company through the Bitvoya Travel website to registered and verified users of Bitvoya Travel (hereinafter referred to as “the Service”).

1.2 The Service includes two types: real-time hotel booking and hotel package booking.

1.2.1 Real-time hotel booking refers to the online hotel booking you make through the Bitvoya Travel website using the account set up by the Company for you. You confirm and agree that the account set up by the Company is for your personal use only, and the hotel booking orders you submit must match your personal ID information. You also guarantee the authenticity, accuracy, and validity of your account and booking information.

1.2.2 Hotel package booking refers to the online hotel package booking you make through the Bitvoya Travel website using the account set up by the Company for you. You confirm and agree that the account set up by the Company is for your personal use only, and the hotel booking orders you submit must match your personal ID information. You also guarantee the authenticity, accuracy, and validity of your account and booking information.

1.3 You understand and agree that the above process of the Service may be adjusted due to changes in applicable scenarios and functional continuity, so the actual service process provided by the Company shall prevail.

1.4 You understand and agree that the Company has the right to revise the content of this agreement based on business operation needs and will announce the latest service agreement in advance through the Company’s website or the Bitvoya Travel website. You should pay attention to and understand the latest service agreement published by the Company. If you cannot agree to the content of the latest service agreement, you have the right to stop using the Service.

1.5 You acknowledge that the hotel prices listed on the Bitvoya Travel website include the actual fees to be paid butdo not include regional city tax, resort tax, environmental tax, etc.

1.6 You acknowledge that the hotel prices listed on the Bitvoya Travel website include local currency prices and RMB prices. The real-time hotel price is based on the local currency price. Exchange rates fluctuate in real-time, and the actual fee you pay and the settlement currency will be based on the local currency and hotel policy.

1.7 You acknowledge that the hotel benefits listed on the Bitvoya Travel website are provided by the hotels. The Company only organizes and displays the benefit information provided by the hotels and does not assume any performance responsibility for the specific content and execution of the hotel benefits.

1.8 You acknowledge that the Chinese room types listed on the Bitvoya Travel website are manually translated by the Company. Please compare the consistency of the room types with other platforms by yourself. The Company does not assume any performance responsibility for the consistency of the room types.

1.9 You acknowledge that the hotel has the right to adjust the content of the hotel benefits based on the hotel’s operational needs without any notice or announcement. The actual benefits provided by the hotel at the time of your stay shall prevail. The Company does not assume any performance responsibility for any adjustments made by the hotel.

Use of the Service

2.1 To meet the validity of the order and the service needs of the hotel, when you use the Service on the Bitvoya Travel website, you need to submit your name, ID number, phone number, bank card information, etc. You authorize the Company to save your name, ID number, phone number, bank card number, transaction orders, transaction records, etc., within the scope of the law, to provide and promote quality services to you continuously. You agree:

2.1.1 You should provide and update your information as required by the Company. If the information you provide is wrong, false, expired, or incomplete, the Company has the right to suspend or terminate providing part or all of the services to you and stop your account usage rights.

2.1.2 You should accurately provide and update your contact information so that the Company can contact you in a timely and effective manner. If youdo not accurately provide and update your contact information, the Company may not be able to contact you and may not be able to provide part or all of the services to you.

2.1.3 You should update your identity information and related materials in time. If you do not update the above identity information and related materials in time, resulting in the inability to use the Service, check in successfully at the hotel, or problems during your stay at the hotel, the corresponding risks shall be borne by you.

2.1.4 When using the Service, you should fill in real, accurate, and valid information to submit your order, including but not limited to the name, gender, number of guests, phone number, credit card information, etc. If you do not fill in accurate information, the corresponding risks shall be borne by you.

2.1.5 When using the Service, the Company has the right to review the authenticity, validity, and accuracy of the order information you submitted and has the right to choose whether to provide services for your order.

2.2 When using the Service, your booking is completed after you successfully submit the order and receive a booking success notification. The hotel has the right to request you to prepay the room fee or deduct the fee from the credit card you provided in advance based on your booking information. The corresponding risks caused by you shall be borne by you.

2.3 When using the Service, the final interpretation of your hotel membership benefits is provided by the hotel or the membership group. The membership policy information provided by the Company is for reference only. Please confirm the accuracy of the benefits with your membership group. The Company does not assume any performance responsibility for your membership benefits.

2.4 When using the Service, the benefits provided by the hotel are for the personal use of the guest whose information is submitted in the order, and the guest must match the real-name authentication information of your registered account. For the consumption quota provided by the hotel, no matter through which channel, platform, or price type you book, you can only enjoy it once during your stay at the hotel.

2.5 When using the Service, for obvious errors in hotel prices caused by server errors, system failures, technical reasons, room type translation, etc., the hotel and the Company have the right to cancel such bookings. The hotel and the Company do not assume any responsibility for this.

2.6 When using the Service, the credit card information you submitted will be transmitted to the hotel by the Company. The Company cannot and will not process the authenticity, validity, accuracy, security, pre-authorization, deduction, etc., of your credit card. Please keep your credit card properly and pay attention to safety when using it. If any abnormal situation occurs with your credit card, the Company does not assume any responsibility for this.

2.7 When using the Service, you may not transfer the Service to any third party in any form, nor may you transfer or provide the hotel benefits to any third party in any form.

2.8 When an order can be freely cancelled, after user cancellation, the paid amount will be refunded to the user’s balance account, which can be used without restrictions for the next booking.

Scope and Limitation of Liability

3.1 If the Company causes actual and assessable losses to your hotel stay, the scope of the Company’s liability is limited to the reasonably foreseeable actual economic losses you suffer.

3.2 The Service is provided based on the current technical level and service capability. The Company will try its best to provide services to you but cannot guarantee that the Service will fully meet your expectations.

3.3 Under the premise of the above terms, you have the right to use the various services of the Bitvoya Travel website and have the right to perform any operations on your orders. The corresponding risks arising therefrom shall be borne by you. The Company does not assume any obligation to notify in advance or any performance responsibility.

3.4 When using the Service, if your behavior includes but is not limited to the following:

(1) Transfer the Service to a third party (2) Transfer the hotel benefits to a third party (3) Unauthorized or irregular cancellation (4) Non-actual check-in behavior (5) Split booking (6) Alternately booking under the same guest name during the same stay period (7) Contact the hotel to modify the guest name by yourself (8) Contact the hotel to prepay the room fee by yourself (9) Use false or invalid credit card information (10) Your account provides booking services for other unregistered users, etc., the Company has the right to suspend or terminate providing part or all of the services to you and stop your account usage rights.

Applicable Law and Dispute Resolution

4.1 When using the Service, you may not violate national laws and regulations or infringe on the legitimate rights and interests of others. You understand and agree that if you are complained about or you complain about others, the Company has the right to provide your subject information, contact information, complaint-related content, and other necessary information to the other party or relevant departments to resolve the complaint dispute in a timely manner to protect your and others’ legitimate rights and interests; unless otherwise stipulated by laws and regulations.

4.2 The signing place of this agreement is the West Lake District, Hangzhou, Zhejiang Province, People’s Republic of China.

4.3 The establishment, validity, performance, interpretation, and dispute resolution of this agreement shall be governed by the laws of the mainland of the People’s Republic of China (excluding conflict of laws).

4.4 Any dispute or controversy between you and the Company arising from this agreement shall first be resolved through friendly negotiation; if the negotiation fails, you agree to submit the dispute or controversy to the competent people’s court in the signing place of this agreement (West Lake District, Hangzhou) for resolution.

Other Provisions

5.1 The headings of all clauses in this agreement are for convenience of reading only and have no actual meaning and cannot be used as a basis for interpreting the meaning of this agreement.

5.2 If any clause in this agreement is invalid or unenforceable for any reason, the remaining clauses shall remain valid and binding on both parties.
